Please read these terms carefully before using the Trumore AI Radio App.
These Terms of Use (“Terms of Use”) are entered into between Türkiye’nin Otomobili Girişim Grubu Sanayi ve Ticaret Anonim Şirketi (“Togg”), located at Bilişim Vadisi, Muallimköy Mah. Deniz Cad. No:143/1, 41400 GEBZE / KOCAELİ, Turkey, and the natural person (“User”) who downloads, creates an account for, or otherwise uses the “Trumore AI Radio” or “On AIRadio” mobile application (“Application”), for the purpose of regulating the mutual rights and obligations regarding the use of the Application. By downloading the App, creating an account, or continuing to use the App, the User acknowledges, declares, and undertakes that they have read and understood this entire Agreement and are bound by all of its provisions. Users who do not accept this Agreement must not use the App and must close their accounts.
1. Definitions
Application: The Trumore AI Radio Application, available at and offered under the name “ On AIRadio,” which refers to the mobile application, website, and all related services designed to process original audio, text, and media inputs using artificial intelligence for music/audio production and/or to provide a personalized listening experience.
Service: AI-powered music production, audio editing, recommendations/personalization, and all related functions provided through the App.
Account: The profile created by the User to access the App, protected by a username/email and password.
Subscription: A billing plan under which the User agrees to make monthly or annual payments to Application Store in order to use the paid tiers of the Service.
Digital Premium Package: means the paid digital service package offered exclusively for Togg smart devices under the Trumore Digital Premium Package Service Agreement, which enables users to access the applications, digital content, premium connectivity, and other additional services included in the package for a specified subscription period.
KVKK: Law No. 6698 on the Protection of Personal Data.
FSEK: Law No. 5846 on Intellectual and Artistic Works.
2. Subject Matter and Scope of the Agreement
2.1 The subject matter of this Agreement is to establish the procedures and principles regarding the User’s use of the Application, the scope of the Service, the mutual rights and obligations of the parties, billing, intellectual property rights, the processing of personal data, and the resolution of any disputes that may arise from the use of the Application.
2.2 This Agreement constitutes a single, integrated whole together with the On AIRadio Information Notice available within the Application or on Togg’s website. To learn more about the processing of your personal data, please review the On AIRadio Information Notice.
3. Scope and Definition of the Service
3.1 The Application is a software service that enables Users to generate and download music, compositions, melodies, audio files, or related materials (“Outputs”) using text, audio, media, and other data types (“Inputs”) through artificial intelligence algorithms.
3.2 Within the scope of this service, the artificial intelligence technology in the Suno application—developed by Suno, Inc., a third-party provider—is used as one of the core components of the production workflow. The framework developed exclusively by Togg encompasses the operational production chain—extending all the way to the finalization of the output on the platform—which includes not the AI model itself, but rather melody composition, lyric writing, compositional architecture, and instrumentation guidelines, as well as prompt sets and a tagging system.
4. Account Creation and Security
4.1 Users must create an On AIRadio account with accurate and up-to-date information to use the service.
4.2 The user is personally responsible for ensuring that the personal data provided during the profile creation and account setup process (username, password, year of birth) remains confidential. If the User suspects unauthorized use of their account, they are obligated to immediately report the situation to Togg via toggcare@togg.com.tr. Togg cannot be held liable for damages resulting from unauthorized use unless it is at fault.
4.3 The Application is available only to users who are at least 18 years of age. Use of the Service by individuals under the age of 18 (or under the age of majority as defined by applicable local law) is subject to parental or legal guardian consent. By creating an Account, the User represents and warrants that they are at least 18 years of age.
4.4 Should a User under the age of 18 use the Service by making a false declaration, any and all legal and criminal liability arising therefrom shall be borne jointly by the User and their parent or legal guardian.
5. Billing
5.1 Monthly and Annual Pricing
The On AIRadio service is available for free with ads; as a premium, ad-free option; and as an ad-free option for those who purchase the Digital Premium Package. The subscription fee for the premium and ad-free options is TRY 29.99 monthly and TRY 299.99 annually in Turkey for 2026; EUR 2.99 monthly and EUR 29.99 annually in Europe; and USD 2.99 monthly and USD 29.99 annually in the United States. Prices may vary depending on the region where the service is offered. Togg reserves the right to update prices. Current prices and usage limits can be viewed under Settings > Manage Subscription within the app.
5.2 Payment and Automatic Renewal
Subscription fees are charged via the User’s preferred payment method (credit/debit card, Apple Store, or Google account). Unless the User cancels the subscription, it automatically renews for the same period at the end of the subscription term, and the applicable amount is charged to the registered payment method after notifying the User within a specified period prior to the renewal date. The User may cancel their subscription through Account Settings at any time before the end of the current period without providing a reason; cancellation does not affect access to the Service until the end of the subscription period.
5.3 Price Changes
Togg reserves the right to make changes to subscription fees. Price increases for current subscribers take effect only as of the next renewal period and are subject to at least [30] days’ prior notice; if the User does not accept the new price, they may cancel their subscription before the renewal date.
5.4 Taxes
Unless otherwise explicitly stated, the published prices include applicable VAT and other statutory deductions.
6. Right of Withdrawal and Refunds
6.1 In accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, the User has the right to withdraw from distance contracts within 14 (fourteen) days. However, since the Service constitutes a “service performed immediately via electronic means” as defined in Article 15, Paragraph 1, Subparagraph (ğ) of the Regulation on Distance Contracts, the User further declares that, by approving the payment for the Subscription**, they have expressly waived their right of withdrawal and consented to the immediate commencement of the Service’s performance**.
7. Intellectual Property
7.1 All trademark, logo, and other intellectual and industrial property rights related to the On AIRadio application belong to Togg. This Agreement grants the User a limited, non-exclusive, non-transferable right to use the Application solely for personal and non-commercial purposes; no other intellectual property rights are deemed to have been transferred or licensed.
7.2 The User is personally responsible for ensuring that neither the User Input nor the Generated Content resulting therefrom infringes upon any third party’s copyright, trademark, personality rights (including voice, image, and name), or other intellectual or industrial property rights. The User agrees not to use the Service to imitate the original work, voice, or style of any artist, composer, or lyricist without permission; to produce derivative content that would create confusion with an existing work; or to present the Generated Content to third parties in such a manner.
8. Prohibited Uses
While using the Service, the User may not engage in the following actions:
In the event of a violation of this provision, Togg reserves the right to remove content, suspend the account, or terminate the agreement for cause under Section 9; furthermore, the User shall be liable for any and all damages arising from such a violation.
9. Content Moderation, Removal, and Account Suspension
9.1 Although Togg is not obligated to review content generated or shared through the Application in advance, it reserves the right to remove or restrict access to any content it determines, at any time and without prior notice, to be in violation of these Terms of Use or applicable laws, through automated filtering systems and/or user reports.
9.2 Togg may temporarily suspend or permanently close a User’s Account if there is reasonable suspicion that any of the prohibited uses listed in Section 8 have occurred, if a legal request or an administrative or judicial decision is served, or if the security of the Account is compromised. In cases of serious or repeated violations, fees paid for the Subscription will not be refunded.
10. Protection of Personal Data
10.1 Togg acts in compliance with all applicable regulations, procedures, and principles regarding the protection of personal data, including the Personal Data Protection Law No. 6698 (“KVKK”) and the decisions of the Personal Data Protection Board. Detailed information regarding the processing and transfer of personal data, the customer’s rights as a data subject, and methods for submitting requests to Togg are provided in detail in the On AIRadio Information Notice.
10.2 During the provision of the On AIRadio service, Togg processes the User’s personal data in compliance with the Personal Data Protection Law (KVKK) and other relevant legislation, solely for specific, explicit, and legitimate purposes, and in a manner that is limited to and proportionate to those purposes. To prevent the unlawful processing of and access to such personal data, to ensure the security of the data, and to protect its confidentiality, Togg stores the data by implementing technical and administrative measures that comply with current technological developments, as required by Article 12 of the Personal Data Protection Law No. 6698, and protects its confidentiality with the utmost care.
10.3 Personal data provided when creating an account within the scope of the application and during the use of the application is retained in accordance with the Law for the reasonable period necessary to achieve the purposes specified in the On AIRadio Information Notice, unless a longer retention period is required by applicable legislation. When the legal basis for processing your personal data ceases to exist, your personal data is destroyed during the first destruction period in accordance with our Retention and Destruction Policy, with the necessary technical and administrative measures taken.
11. Limitation of Liability and Indemnification
11.1 The User agrees to indemnify Togg against any and all claims, lawsuits, damages, and expenses (including attorneys’ fees) arising from User Input that violates this Agreement, applicable laws, or the rights of third parties; from the commercial or public use of Generated Content; or from the unauthorized use of the User’s Account.
12. Term and Termination of the Agreement
This Agreement enters into effect when the User begins using the Application and remains in effect until the Account is closed.
The User may deactivate their Account at any time through the App settings; in this case, access to the Service will continue until the end of the current Subscription period, but no refund will be issued for the unused portion of the period.
Togg reserves the right to immediately terminate this Agreement without compensation and close the Account if the User violates this Agreement, particularly the prohibited uses listed in Section 8.
14. Force Majeure
Natural disasters, war, terrorism, riots, epidemics, cyberattacks, infrastructure/internet outages, changes in legislation, suspension of service by a third-party artificial intelligence model provider, or similar circumstances beyond the reasonable control of the parties shall be deemed force majeure. In the event of force majeure, the affected party shall be exempt from liability only for the duration during which it is unable to perform its obligations.
15. Governing Law and Dispute Resolution
Disputes arising from this Agreement shall be governed by the laws of the Republic of Turkey. For disputes falling within the monetary limits set forth in Law No. 6502, the Consumer Arbitration Boards located in the place of residence of the User or Togg shall have jurisdiction; for disputes exceeding these limits, the Consumer Courts shall have jurisdiction.
16. Notifications
Notices to be sent by Togg to the User shall be made via the email address registered in the Account or through in-app notifications; notices to be sent by the User to Togg shall be made to the address toggcare@togg.com.tr.
17. Entry into Force
This Agreement enters into force upon the User’s downloading of the App and creation of an Account or upon the User’s selection of the “I Accept” option, and is presented to the User for acceptance electronically; furthermore, it does not require a wet signature.
